1. GENERAL PROVISIONS
1.1. This document constitutes a public offer issued by
CULTMODA OÜ, registered in Estonia (hereinafter referred to as the “Service Provider”), and sets forth the terms and conditions for the provision of educational services in the form of online courses and/or webinars, as well as personal styling services.
1.2. Pursuant to Section 9 of the Estonian Law of Obligations Act, this document constitutes a public offer. Acceptance of the offer (payment for an educational product and/or personal styling services) constitutes full agreement by the User (hereinafter referred to as the “Client”) with the terms set forth herein.
2. DEFINITIONS
2.1.
Acceptance — the full and unconditional acceptance by the Client of the terms of this Agreement through payment for the educational product.
2.2.
Course — an educational program consisting of live online sessions (lectures) conducted by an instructor in real time.
2.3.
Webinar — a live online session conducted via video conference with the possibility of participant interaction.
2.4.
Materials — recorded lectures, presentations, and supplementary resources provided after the sessions.
2.5.
Website — the Service Provider’s website located at:
https://www.cultura-moda.com3. SUBJECT OF THE AGREEMENT
3.1. The Service Provider undertakes to provide the Client with educational services in the format of online lectures and/or webinars, including subsequent access to session recordings and supplementary materials.
3.2. The services shall be deemed duly provided from the moment access to the educational materials is granted to the Client.
4. PERSONAL SERVICES
4.1. The Service Provider offers personal styling services, the list and pricing of which are indicated on the Website.
4.2. Personal styling services are provided upon prior request by the Client. After submitting a request, the Service Provider contacts the Client to agree upon the stages of work, deadlines, and other service conditions.
4.3. Personal services shall be deemed duly provided upon completion of the agreed service stages.
5. CONCLUSION OF THE AGREEMENT
5.1. The Agreement is deemed concluded once the Client submits a request on the Website, receives payment details via email, and completes the payment.
5.2. Payment constitutes full acceptance of all terms of this Agreement.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The Service Provider undertakes to:6.1.1. Conduct online sessions and/or webinars within the announced timeframe.
6.1.2. Provide access to recordings and supplementary materials after the sessions.
6.1.3. Provide technical support in case of access issues.
6.1.4. Deliver personal styling services in accordance with individual agreements.
6.2. The Client undertakes to:
6.2.1. Pay for services in accordance with the terms of this Agreement.
6.2.2. Not share course or webinar materials with third parties.
6.2.3. Comply with the learning rules established by the Service Provider.
6.2.4. Provide necessary information required for personal styling services.
7. PRICE AND PAYMENT TERMS
7.1. The cost of services is indicated on the Website.
7.2. Payment shall be made according to the details provided in the email sent after submission of the request.
7.3. Refunds are possible only in cases предусмотренных by the Service Provider’s Refund Policy.
8. LIABILITY
8.1. The Service Provider shall not be liable for the Client’s inability to participate due to circumstances beyond its control (including technical issues on the Client’s side, lack of internet access, etc.).
8.2. In case of violation of this Agreement by the Client, the Service Provider reserves the right to block access to the course without refund.
8.3. The Service Provider shall not be liable for the Client’s subjective dissatisfaction with the results of personal styling services.
9. FORCE MAJEURE
9.1. The Parties shall be released from liability for failure to fulfill obligations due to force majeure circumstances.
10. CONFIDENTIALITY
10.1. The Service Provider undertakes not to disclose the Client’s personal data to third parties without consent, except as required by Estonian law.
11. TERM AND TERMINATION
11.1. This Agreement enters into force upon acceptance and remains valid until completion of the services.
11.2. The Service Provider reserves the right to unilaterally amend this Offer by publishing a new version on the Website.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1. Any disputes arising in connection with this Agreement shall be resolved through negotiations, and if unresolved — in the courts of Estonia.
